The term "Website" pertains to www.cruise.inspiringvacations.com, while "Package" refers to the product purchased on the Website and all its advertised features.

Website Information

All care is taken to ensure that the information published on the Website with regards to the destination, package or its components is accurate. In some cases, the information provided may serve only as a guide and actual circumstances may differ whilst on tour, such as routing or accommodation. Packages or excursion itineraries may change or be different from those described in the brochure as a result of local conditions, weather conditions and annual events. Cruises by Inspiring Vacations will endeavor to notify you of any significant changes prior to your departure. Material published on the Website should not be viewed as advice and is provided for information purposes only. We recommend that you familiarise yourself with the components of the package prior to purchase. Cruises by Inspiring Vacations reserves the right to alter Website information at any time without notice.

Cruises by Inspiring Vacations reserves the right to restrict access to the Website, from communicating with Cruises by Inspiring Vacations or from completing a booking for any reason and at any time at its sole discretion.

Use of the Website

You agree not to use the website in any way that interferes with its normal operation. Any data gathering or extraction methods are strictly prohibited without prior consent. Any information or intellectual property owned or licensed by Cruises by Inspiring Vacations and published on the Website shall not be copied or commercialised without the prior consent of Cruises by Inspiring Vacations. Where payment is processed on the Cruises by Inspiring Vacations website, you warrant that the details used are your own or those of a third party who has consented for you to use those details and that you are fully responsible for their use.

Membership with Cruises by Inspiring Vacations

To make purchases using the Website, users will be signing up as an Cruises by Inspiring Vacations member.
By signing up as a member, you accept and agree that:

Membership with the Cruise operator

By making a purchase using this website, users will be signed up with the cruise operator, which may result in you recieving SMS and email communications from the cruise operator directly.

Users have the discretion to unassign to marketing content at anytime direct with the cruise operator.

You will be subject to and will abide by the terms by the terms and conditions in this document and the cruise operators terms account terms and conditions.

These Terms & Conditions

You agree that every booking is subject to the terms & conditions in place at the time of your booking. These terms are available for review prior to booking. Further, these terms will continue to be available online.

Cruise Bookings

Cruises by Inspiring Vacations acts as agent on behalf of cruise lines (the Cruise Supplier) in the provision of cruise booking services (the Cruise Booking Service). Cruises are ultimately fulfilled by the applicable Cruise Supplier according to their terms & conditions and fare rules in addition to Cruises by Inspiring Vacations' standard terms & conditions. Should Cruises by Inspiring Vacations terms & conditions conflict with those of the Cruise Supplier, Cruises by Inspiring Vacations’ terms & conditions will apply.

You acknowledge that any cruise booking is separate to any other booking with Cruises by Inspiring Vacations. Different terms will apply to different your cruise and any other booked components, whether booked at www.inspiringvacations.com or cruises.inspiringvacations.com. The applicable supplier will be described in the product description. The operation of the cruise is entirely the responsibility of the Cruise Supplier and Cruises by Inspiring Vacations will not be responsible for any loss resulting from the customer's participation in that cruise.

You acknowledge that, as agent, any payments made to Cruises by Inspiring Vacations includes payments for the Cruise Supplier in return for the cruise as well as for Cruises by Inspiring Vacations for the provision of the Cruise Booking Service.

Airfare Bookings

Cruises by Inspiring Vacations acts as agent on behalf of airlines (the Airline Operator) in the provision of flight booking services (the Flight Booking Service). Flights are ultimately fulfilled by the applicable Supplier according to their terms & conditions and fare rules in addition to Cruises by Inspiring Vacations standard terms & conditions. Should Cruises by Inspiring Vacations terms & conditions conflict with those of the Flight Supplier,our terms & conditions will apply.

You acknowledge that, as agent, any payments made to Cruises by Inspiring Vacations includes payments for the Flight Supplier in return for the flight as well as for Cruises by Inspiring Vacations for the provision of the Flight Booking Service.

All Other Bookings

Where you have completed any other booking type on the Cruises by Inspiring Vacations website, these standard terms & conditions will apply.

Airfares

Once airfares have been booked, regardless of whether details have been provided to the customer, any changes will incur fees from both Cruises by Inspiring Vacations and the airline. Airfares will be booked according to the information provided by the customer and Cruises by Inspiring Vacations will not be held liable for any costs resulting from the provision of incorrect information. Any change to flight timing or aircraft type (if advertised) will not entitle the customer to cancel or change to other arrangements without paying any applicable cancellation fees except where specified in these booking conditions.

In the event of a schedule change, delay or disruption, which remain at the sole discretion of the airline, Cruises by Inspiring Vacations will not be held liable for any resulting costs, such as those incurred in joining the tour at a different location or additional accommodation, or refund any package component not received. It is the customer’s responsibility to familiarise themselves with the terms and conditions specific to the airline, such as with regards to luggage limits or conditions of carriage, and to regularly check schedules prior to departure for any changes. Cruises by Inspiring Vacations will not be liable for any costs resulting from a change in airport within a departure city.

Airfares Separate From Other Components

While we seek to provide a seamless booking experience, you agree that any flight arrangement made with Cruises by Inspiring Vacations is independent of any other travel component booked. While all reasonable effort will be made to ensure your travel operates without interruption, any flight booking will be viewed independently from any land, cruise or other flight component. Flight bookings may require different payment terms, which will be advised at the time of booking, and will be subject to the terms of the carrier booked in addition to the Cruises by Inspiring Vacations Terms & Conditions.

Where the flight itinerary is chosen and confirmed by the customer, it remains the customer's responsibility to ensure flights are booked to meet the requirements of the travel package as published on the package itinerary. This includes flight itineraries suggested by Cruises by Inspiring Vacations as part of its booking system. You agree that Cruises by Inspiring Vacations is not liable for any loss or damage resulting from an interruption, change or cancellation of your flight arrangements with regards to other travel components booked. Further, you agree that Cruises by Inspiring Vacations is not liable for any loss or damage resulting from an interruption, change or cancellation of your tour package with regards to your flight arrangements.

Prices

Payments made to Cruises by Inspiring Vacations may be subject to transaction fees, which include fees for credit card payments. The applicable fees will be disclosed when you make the payment.

To complete a booking, you may need to make a deposit or pay the full amount. The prices and payment terms for the booking are clearly stated on the Website before you make your booking unless there are promotional campaigns or special offers that have different terms. The pricing may be based on a per person twin share basis. It is your responsibility to carefully review your order before making the payment, as refunds may not be available and cancellation fees may apply if you decide to cancel.

The published prices are valid for a limited time and may change periodically due to factors such as fluctuations in the cost of the cruise components or special offers. Cruises by Inspiring Vacations may change the price of its packages or the required deposit amount at any time without notice. These changes will apply to bookings made after the changes are implemented. If you made a purchase before a price decrease, you will not be eligible for a refund or adjustment of your deposit amount. As a result, customers traveling on the same departure may have paid different amounts, and no refunds will be provided for differences in pricing. The final prices will be confirmed at the time of booking.

We reserve the right to not honor any published prices that we determine to be incorrect due to errors in printing, clerical mistakes, or electronic errors, except in cases of obvious errors made by us.

After booking, the price you need to pay may be affected by various factors, including any customizations or additions you made to the booking, changes to travel arrangements, currency fluctuations, fuel surcharges, government taxes, levies, and increases in airfare (where included). This includes changes to the base package price in addition to optional extras or upgrades, such as optional tours or pre- or post-tour accommodation, for example. Any extras that you may wish to add post purchase will be subject to the current advertised price (and subject to availability). Where the cost of delivering the package materially increases between the time of purchase and delivery, Cruises by Inspiring Vacations reserves the right to increase the price payable and this will be reflected on the customer's invoice.

You are responsible for making all payments, including any additional charges for optional activities or changes to the booking. If you have only paid a deposit, you will need to make the final payment by the stipulated due date on your invoice, regardless of whether there are other travellers in your booking or if you are making the purchase on behalf of someone else. If payment is not settled by the due date, your booking may be immediately cancelled. In such a case, refunds or reinstatement of the booking may not be available. If it is agreed to reinstate a booking, fees may be applied.

Payment Options

Purchases on www.cruises.inspiringvacations.com offers credit card options as the form of payment. You will be presented with a personalised booking payment plan which cannot be altered. Where you are within close proximity to departure, or where you have selected a promotional fare, you may be required to settle the full value of the package at the time of booking.

The total amount payable, the specific amounts due and their payment due dates will be clearly published on the relevant package page and in the Checkout prior to finalising your booking and making payment.

Customer Details

Personal information is required in order to book the components of your package and will be handled according to Cruises by Inspiring Vacations’ Privacy Policy. Failure to provide information in a timely manner or the provision of inaccurate information may result in additional charges from Cruises by Inspiring Vacations and third-party suppliers or the denial of service. Cruises by Inspiring Vacations will not be liable for any costs or denial of service resulting from incorrect details.

All bookings should be reviewed upon confirmation to ensure all details are correct and to communicate any errors as soon as possible.

Your information will be accessible through the online My Trip portal using your unique booking ID and lead passenger email. Whilst your booking details will not be shared, we ask you to keep these details secure. Cruises by Inspiring Vacations will never ask that you share your login details or request that you attempt to log in on any website other than on the domain ‘www.cruises.inspiringvacations.com’. You agree that Cruises by Inspiring Vacations will not be liable for any loss resulting from you sharing login details with a third-party.

Comparative Pricing

Where a comparative ‘typically’ price is displayed next to the advertised price, it should be taken as a comparison to a product of similar duration, standard of travel and inclusions to that destination that is available for sale to the public for a similar time of travel. Where a comparative product of the same duration cannot be found, an average price per day may be used. Where a comparative product of similar inclusions cannot be found, the products of multiple providers may be combined to produce a comparative price.

Inventory

While all reasonable efforts are made to accurately publish availability, in the event that your booking is not confirmed, a full refund will be provided to the same method of payment used to arrange the booking. If account credit has been used, a return of that credit will be provided to the customer's Cruises by Inspiring Vacations account. In such circumstances, Cruises by Inspiring Vacations will not be liable for any other expenses or loss incurred.

Traveller Details Form

In order to arrange your travel, the cruise operator must be provided with your traveller details submitted on the consumers behalf during the purchase path. Cruises by Inspiring Vacations will not be liable for any additional fees resulting from any delays in confirmation or cancellation of your booking due to a failure to submit passenger details.

All Other Offers

From time to time, offers and promotions will be made available to customers either directly by Cruises by Inspiring Vacations or through 3rd party channels and websites. Unless explicitly stated otherwise, the following terms and conditions apply to these offers:

The offer is only available where bookings are made directly by the customer, not by a travel agent.

The offer and / or any associated discount cannot be applied to prior or existing bookings made outside of the promotional dates.

The offer and/or any associated discount is not redeemable for cash and cannot be used in conjunction with any other offer.

The product fine print applies in conjunction with Cruises by Inspiring Vacations’ standard terms & conditions.

Cruises by Inspiring Vacations reserves the right to end any offer at any time at its absolute discretion.

Exclusions

Anything not described in the package terms or itinerary are not included in your package. Anything specifically mentioned as an Exclusion is not intended to be exhaustive.

Minors

Please refer to individual package terms to determine whether travelling with minors is permitted and minimum ages. Where permitted, all travellers under the age of 18 must be accompanied by an adult. All accommodation must be shared with an accompanying adult.

Tipping

While not prevalent in Australia, tipping is an important custom in many parts of the world and may or may not be included in your package. Where tipping is not included, any amount paid is entirely at your discretion and no reimbursement will be provided upon your return. However, in recognition of great service and with regard to local traditions, we recommend you partake in this practice. Guidelines may be provided prior to departure and, while all reasonable care is taken to ensure they accurately reflect local expectations, recommended tipping may change. Where tipping is included in the package, no refund will be available.

Contact while travelling

It is expected that you will be contactable via phone and email while you are travelling, where local service coverage is available. This may often be in the form wi-fi networks provided by hotels or other service providers and we recommend that you consult your service provider to understand your plan. It may be necessary to contact you regarding important updates to your booking or in the unlikely case of emergencies. Note that any service costs involved will be the responsibility of the traveller.

Hotels

Requests for specific room types are subject to availability and cannot be guaranteed. While all reasonable efforts are made to secure non-smoking rooms, this may not be possible due to local customs.

Hotel check-in is subject to the timing stipulated by the hotel. Early check-in will not be provided where flights arrive early and late check-out will not be provided where flights depart late. Availability of early check-in or late check-out is at the discretion of the hotel and the customer is responsible for any additional costs.

Where for reasons beyond our control a hotel is no longer available, an alternative will be arranged of similar or higher quality.

Transfers (Jayride)

You may have the option of arranging arrival or departure transfers in conjunction with your booking, using a service offered and managed by Jayride Group Limited (ACN: 155 285 528) ('Jaryride').

In addition to Cruises by Inspiring Vacations standard terms & conditions, any service arranged through Jayride will be subject to their terms & conditions found HERE. Refunds may be available with no cancellation fees up to 48 hours prior to the pick-up time, subject to the terms of the transfer booking.

Cruises by Inspiring Vacations acts as agent on behalf of Jayride and any service is delivered by Jayride and the ultimate transfer service provider. You acknowledge that, as agent, any payments made to Cruises by Inspiring Vacations includes payments for Jayride for the transfer service as well as for Cruises by Inspiring Vacations as commission as agent. Cruises by Inspiring Vacations cannot be held liable for any loss resulting from the transfer service provided by Jayride or the ultimate service operator. It is the customer's responsibility to ensure any transfer booked meets the requirements of any other travel arrangements. Any transfer booking is separate to any other booking with Cruises by Inspiring Vacations, regardless of whether purchased with regards to the same travel journey.

Free Time

Any activity undertaken during any free time whilst on tour is at the discretion of the individual traveller and Cruises by Inspiring Vacations will not be responsible for any circumstances arising from those activities. This includes shopping and Cruises by Inspiring Vacations carries no liability for the quality or delivery of any items purchased and the use of any payment method is entirely at the customer's own risk.

Public holidays/festivals

Virtually all countries have public holidays, religious or otherwise. The festivities may temporarily disrupt your holiday and some religious holidays may result in a reduction of facilities and entertainment.

Health & Fitness

Everyone deserves to be inspired by travel and we welcome anyone seeking to explore the world’s great destinations. When offshore, note they may involve long days, walking, climbing stairs, the carrying of luggage and extreme heat or cold, and we recommend that you familiarise yourself with the itinerary to ensure the suitability of the package to your abilities. Should there be any hesitations, we recommend you consult a doctor.

At the time of booking, any disability or medical condition that may require assistance while on tour must be disclosed. Cruises by Inspiring Vacations will make all reasonable efforts to ensure those requirements are catered for, however we cannot guarantee that all component service providers will comply with your request and we will not be held liable for any failure to accommodate your requirements or for any denial of service. Further, Cruises by Inspiring Vacations will not be liable for any injury, illness or loss of enjoyment resulting from any disability or medical condition. Where a component of a package, or the package in its entirety, is not able to be provided as a result of a disability or medical condition, no refund will be available. Cruises by Inspiring Vacations reserves the right to remove a passenger from the group for health & fitness related reasons and will not be liable for any resulting loss or additional costs.

Medical Assistance

It is the customer's responsibility to obtain any medical assistance required. Cruises by Inspiring Vacations will not be liable for any costs incurred or for the quality of care provided.

Travel Insurance

Travel insurance is not included in your package. You are required to purchase comprehensive travel insurance at the time of booking that includes (without limitation) coverage for the cost of your holiday package, medical expenses, cruise cover, loss of luggage, cruise and land content and airfare changes that may occur due to cancellation, impossibility of performance or other frustration, disruption, loss of deposit or strikes. Cruises by Inspiring Vacations does not provide advice in relation to travel insurance. While customers may be referred to a nominated travel insurance provider, Cruises by Inspiring Vacations does not represent that provider and any resulting purchase of insurance is at the customer’s sole discretion.

Our COVID-19 Travel Policy

We understand that circumstances related to COVID-19 can be uncertain and we want to ensure our travellers are well-informed about our policies regarding such situations.

Before you travel:

While it is not compulsory for travellers to be vaccinated against COVID-19 to travel with Cruises by Inspiring Vacations unless otherwise stated, we strongly encourage that they be fully vaccinated prior to travel. It is important for travellers to be aware that airlines and local government authorities may have different guidelines depending on the destination.

Unless otherwise stated, travel insurance is not mandatory. However, we strongly recommend that you obtain travel insurance prior to your trip that encompasses unanticipated circumstances, including accidents and illnesses such as COVID-19. Should your travel plans become impacted by COVID-19, you will be referred to your travel insurance provider for assistance in recuperating any out of pocket expenses as a result.

During your travel:

COVID-19 requirements are constantly evolving and differ from country to country and region to region. If you receive a positive test result while traveling with us, you must adhere to the regulations of the country or region you are in and may not be permitted to continue traveling with the group. In the event of local government requirements, you may be required to self-isolate for a specific number of days. This is something our local team will advise at the time. Our local team will do their best to help you make arrangements for extended accommodation if local isolation is necessary.

If isolation is a requirement or you are choosing to return home prior to the conclusion of the trip, our team will email you a passenger release form that must be completed and returned as soon as possible for our records. Please note that any additional arrangements needed outside of the standard package will be at the travellers expense, so we ask that all payment records are obtained so you can make a claim through your travel insurance provider once you return home.

As COVID-19 still poses a risk to individual health, we ask that you assume personal responsibility for your own well-being and consider how your personal situation may affect the health and well-being of others. Cruises by Inspiring Vacations reserves the right to prohibit you from continuing to travel with the group if your health status poses a risk to your safety or that of other travellers or staff.

Entry or Service Requirements

It is the customer’s responsibility to investigate the visa requirements of their intended destination and to ensure they have a valid visa and passport. Your requirements are dependent on your own personal circumstances and Cruises by Inspiring Vacations is not in a position to provide advice nor be held liable for any denial of service resulting from a failure to procure a valid visa or passport.

Certification of your medical history, such a proof of COVID-19 vaccinations, may be required for entry to certain countries or to be eligible for certain services. It is the customer's responsibility to familiarise themselves with these requirements and to ensure that they are compliant. Cruises by Inspiring Vacations cannot be held liable for any losses resulting from denied service or unused package components in the case of non-compliance. Cruises by Inspiring Vacations cannot be held responsible for any changes in requirements between the date of booking and the expected date of service. Any non-compliance may require you to cancel your booking, which will be considered voluntary in nature and normal cancellation terms will apply.

Travel Advice

It is the customer’s responsibility to be aware of conditions in their intended destination before and during their travel. We recommend you review the information published on www.smarttraveller.gov.au and to register your travel plans.

Complaints

Whilst away, any complaints should in the first instance be communicated directly with the hotel or cruise concierge so your concerns can be resolved in a timely manner with proper communication. Failure to do so may result in any claim for compensation to be reduced or denied.

Should you wish to contact our dedicated team directly, please email cruises@inspiringvacations.com within 30 days from the completion of your package. Communication after this time may result in any claim for compensation being reduced or denied.

Use of Account Balance or Credit

If you have used an available Account Balance or Credit, including promotional credit to make a new booking or towards a payment on an existing booking, please note that this remains non-refundable at all times. Credit issued by Cruises by Inspiring Vacations will only be available for use on the Cruises by Inspiring Vacations website. At the time of purchase, your credit will be drawn down to the value of your booking or until no further credit remains. Any difference will require payment according to that package's payment terms and any remaining credit will be available for future use.

If you have an available Account Balance or Credit with a specific cruise or airline operator, you must contact them directly to proceed with a booking.

Refunds

For the avoidance of doubt, any indication that may be provided as to a refund available to you should be taken as an estimate and may be dependent on funds being returned by independent third-parties suppliers. Any refund will be processed back to the same method of payment, including to credit if payment was made using credit. Any refund is reliant on the reimbursement from the operators.

Errors & Omissions

Information published on the Website may be dependent upon various sources, including from third-party travel providers. While all reasonable care is taken to ensure information is accurate and up to date, errors or omissions may occur from time to time.

Such errors or omissions may include, but are not limited to, circumstances where (a) incorrect pricing prohibits the confirmation of that booking at the published price (b) incorrect inventory prohibits the confirmation of the booking in any form (c) a pricing error results in a materially unreasonable outcome, such as a luxury package secured for $1.00.

In such circumstances, we reserve the right to amend your booking in consultation with you. Further, Cruises by Inspiring Vacations reserves the right to cancel your booking without liability and provide a full refund.

Documentation

The package terms and itinerary will contain most of the information relevant to your package and should be the first point of reference for any itinerary related queries. Specific booking information will be provided approximately 14-30 days prior to travel. Information may be provided earlier as they become available at the discretion of the operators or will alternatively be provided in the timeframe indicated. The distribution of documentation may be dependent on the third-parties operating your booking and so unforeseen delays may be beyond the control of Cruises by Inspiring Vacations. The non-delivery of documentation for any component, such as an airline eticket, should not be taken to indicate the level of fulfilment completed to date.

Special Requests

Any special requests should be detailed in your booking form and, while all reasonable efforts are made to satisfy your requests, Cruises by Inspiring Vacations will not be liable for any injury, illness or loss of enjoyment resulting from a component service provider’s failure to satisfy your request.

All reasonable efforts will be taken to satisfy seating or cabin requests, however Cruises by Inspiring Vacations will not be responsible for any changes made at the discretion of the third party provider.

Change Requests

Any request at the time of booking to vary the standard package is on a request basis only and Cruises by Inspiring Vacations does not guarantee that the request will be met. Any request after booking may be denied at the discretion of Cruises by Inspiring Vacations. All changes will incur a change fee of $75 per person in addition to any further charges resulting from the request. Where the request requires additional fees, a quote and invoice will be provided which must be paid by the expiry time listed. Payment of the invoice will be taken as acceptance of the quote and any amount paid becomes strictly non-refundable. Where payment is not received by the expiry time the quote will be cancelled and Cruises by Inspiring Vacations reserves the right to deny any future request. Should an additional quote be provided, Cruises by Inspiring Vacations cannot guarantee that the same terms and price will be available.

Conduct

Cruises by Inspiring Vacations holds a strong stance against racism, harassment, and any form of inappropriate behaviour towards other travellers or our in-country representatives. We believe in fostering an inclusive and respectful environment for all travellers on our tours. We are committed to providing an enjoyable and memorable experience for all travellers, regardless of their background, sexual orientation, race, ethnicity, gender, or any other characteristic, and we have a zero-tolerance policy towards such actions.

If a traveller is found engaging in any inappropriate behaviour and to ensure the comfort and safety of our customers, Cruises by Inspiring Vacations and the local operators reserves the right to remove them from the cruise This decision is made to maintain a safe and respectful environment for all participants. It is important to note that no refund will be provided to individuals who are removed from the tour due to their inappropriate behaviour. Additionally, any additional costs incurred as a result of their removal will not be the responsibility of Cruises by Inspiring Vacations.

We encourage all travellers to respect one another, embrace diversity, and contribute to a positive and inclusive atmosphere throughout the tour. We believe that by upholding these values, we can create a truly enriching and rewarding travel experience for everyone involved.

Weather and Seasonality Predictions

Across our range of tours and destinations, there will be peak season times of travel, which generally revolve around the best weather expected or local events hosted during a season, Cherry Blossom season in Japan being an example. We rely on weather reports provided at the time of releasing a tour, along with expert information provided by our local partner, when it comes to highlighting which of our departure dates fall over peak season. While every effort is made to ensure that we schedule our tours over the most favourable time to experience local events, changes in expected weather conditions will have an impact on these predictions, which unfortunately is beyond our control. Customers will not be entitled a refund or compensation should their tour be impacted by a change in weather or seasonality predictions.

Bookings Through A Travel Agent

Your travel agent will forward deposits and other payments to us on your behalf, but your travel agent is not our agent for the purpose of receipt of monies. Receipt of deposits and subsequent payments by the travel agent does not constitute receipt of those monies by us and the travel agent has no authority expressed or implied to receive monies on our behalf. There is no liability on the part of Cruises by Inspiring Vacations in respect to any monies paid to your travel agent unless and until Cruises by Inspiring Vacations notifies you (by way of a booking confirmation advice or payment receipt advice) that monies have been received by Cruises by Inspiring Vacations. Cruises by Inspiring Vacations reserves the right to cancel any ticket or booking or refuse to carry any passenger where payment has not been received by Cruises by Inspiring Vacations within the specified time.

Group Booking Responsibility

When booking for a group, it is essential that every traveller reads and agrees to our standard terms and conditions before proceeding. It is the responsibility of the customer that Cruises by Inspiring Vacations has been advised when travelling in a group. Whilst we assist in facilitating your booking, it is the cruise line’s responsibility to pair the group according to any request.

Traveller Information

Upon making a booking through our website, you are required to provide us with all travellers' details, including their full names as per their passports, passport numbers and expiration dates, nationalities, dates of birth, genders, rooming preferences, dietary requirements, and any medical concerns. Where details are provided incorrectly, a Cruises by Inspiring Vacations fee of $75 per person will apply in addition to any third-party operator costs.

Cancellation, Changes and Refund Policy

Introduction

The following policies apply to all bookings made through www.cruises.inspiringvacations.com unless otherwise specified in an individual product’s Fine Print from the date of issue. Please consult the terms & conditions issued at the time of your booking to understand which terms apply to your booking. Cruises by Inspiring Vacations acknowledges that the Australian Consumer Law provides various statutory guarantees and nothing in this policy is intended to affect your rights under those guarantees.

The cancellation or modification of a booking may incur two different types of costs: those charged by Cruises by Inspiring Vacations and those charged by third-party operators, such as an airline, cruise operator and hotel provider. While Cruises by Inspiring Vacations seeks to be transparent in the fees that it charges as detailed below, any fees charged by a third party will be according to their own policies over which Cruises by Inspiring Vacations has no control. The fees charged by a third party may depend on the proximity to booking, the proximity to travel and the progress made in fulfilling the various components of the package. While these third-party fees could be significant, Cruises by Inspiring Vacations will not charge any amount greater than the fees specified below.

Travel Insurance

All travellers are advised to obtain appropriate travel insurance immediately after booking to ensure they are sufficiently protected against the unexpected. It is the customer’s responsibility to obtain and understand the terms of their policy. Cruises by Inspiring Vacations does not provide advice with regards to travel insurance.

Cruises by Inspiring Vacations is not an insurer and so cannot be responsible for providing financial support other than as stated in this policy and under the Australian Consumer Law.

When refunds will be available

Once payment has been made, your deposit will be non-refundable. After this time, you will be subject to our cancellation terms and conditions.

In circumstances where a refund has been agreed by both parties, reimbursement will not be paid until funds have been received by all third-parties.

Refunds may be available in certain circumstances, including when specifically provided for in this policy or in an individual product’s Fine Print or when required by law to do so.

When refunds and credits will not be available

For the avoidance of doubt and subject to the above, refunds will not be available in the following circumstances:

- when there is a voluntary ‘change of mind’;

- where you have failed to read the Cruises by Inspiring Vacations Terms & Conditions or the Fine Print of the purchased product;

- if you fail to obtain the correct travel documents, including in relation to passports, visas or medical certificates;

- where your experience of the travel package has not met your expectations;

- where you are dissatisfied with reasonable amendments to your travel itinerary;

- if you are deemed to ‘no-show’, such as by failing to check-in for your flight on time;

- if you are unable for any reason to arrive at a tour starting point by the designated time;

- where you have failed to obtain appropriate travel insurance;

- where you choose to cancel your booking prior to a formal suspension notice by Cruises by Inspiring Vacations

- where you choose to cancel your booking due to your concerns about the travel destination but where your package is expected to proceed;

- your travel is prevented due to a Force Majeure event;

- where an arranged service cannot be delivered due to reasons beyond the control of Cruises by Inspiring Vacations;

- where your booking is cancelled due to abuse, harassment or any kind of inappropriate or illegal behaviour;

- if you hold a credit from previously disrupted travel;

- if your credit has expired; or

- any other reason unless specifically mentioned within these terms as being eligible for a refund or credit.

Booking Changes

Booking changes may include, but are not limited to, name changes and name corrections.

A fee of $75 per person will apply per requested booking change in addition to any costs charged by third-parties in relation to the change.

Note that airlines can charge significant fees, even for minor name corrections. In some cases, an entirely new ticket may need to be issued. As such, it is important to verify all details in your passenger details form as submitted at time of booking and that your full name matches that in your passport.

Should a booking change result in excess payments, these will be issued to you as a credit.

Booking Cancellation

Should you decide to cancel your booking, the below Cruises by Inspiring Vacations fees will apply in addition to any costs charged by third-parties.

Deposit - Non refundable

120 days or more prior to departure - deposit + 10% of package price

119 days or less prior to departure - 100% of the package price

Cancellations will include, but are not limited to, the full cancellation of your booking, the cancellation of one passenger on a booking and a change in package.

If a refund is ever issued by the cruise operator in accordance with their terms and conditions, it will be processed and refunded to you by Cruises by Inspiring Vacations using the payment method specified by the operator. Processing fees will be charged by Cruises by Inspiring Vacations.

Reimbursements are contingent upon funds being returned to Cruises by Inspiring Vacations, and please be aware that no reimbursements will be issued until they are available.

If there have been administration charges and changes to your booking previously, these costs will be non-refundable in the event of a cancellation.

Changes or Cancellation by Cruises by Inspiring Vacations

Cruises by Inspiring Vacations endeavours to provide you with all the services confirmed to you at the time of your booking. However, Cruises by Inspiring Vacations plan arrangements a long time in advance of your departure date using independent suppliers such as airlines, hotels and cruises, over whom we have no direct control. On occasions that changes do have to be made, Cruises by Inspiring Vacations reserves the right to cancel or amend bookings accordingly and will not be liable for any other expenses or loss incurred.

This may include circumstances where your booking cannot be confirmed by the third-party provider or is later cancelled by that third-party provider. Cruises by Inspiring Vacations works with various third-parties to provide your package over which the company has no control.

Where Cruises by Inspiring Vacations chooses to cancel a booking, it will provide a refund of all amounts paid less those amounts unrecoverable from third parties. This does not include circumstances where a booking is cancelled due to a Force Majeure event. Cruises by Inspiring Vacations will not be liable for any other loss resulting from a booking being cancelled or not being confirmed. Refunds will be made to the same method of payment, which may include the issuing of a credit if credit was redeemed to arrange the booking. Refunds will only be paid once funds have been received from third-parties, the timeframe for which will be beyond the control of Cruises by Inspiring Vacations.

Hardship Policy

A partial cash refund may be considered in special cases involving uninsurable financial or health-related hardship, subject to the reasons above where a refund will not be available. Supporting documentation will be requested, such as verification of reduced income or an inability to travel for health reasons and evidence of an unsuccessful insurance claim. Costs will be withheld for any amounts unrecoverable from third-parties and amounts incurred in the procurement, acquisition, management and fulfilment of your booking. Any refunds will be at the sole discretion of Cruises by Inspiring Vacations.

Should funds be recoverable from third parties, they will only be refunded to you once received by Cruises by Inspiring Vacations. Note that the timeframe for receiving funds from third-parties may take some weeks or months and is beyond the control of Cruises by Inspiring Vacations.

Force Majeure

Force majeure means the occurrence of an event that is beyond Cruises by Inspiring Vacations’ reasonable control and which could not have been reasonably prevented by Cruises by Inspiring Vacations, which includes, but is not limited to: (a) war, armed conflict, criminal damage, riot, civil strife, industrial dispute, terrorist activity or the threat of any such acts; (b) natural disasters (including but not limited to flooding, fire, earthquake, landslide, adverse weather conditions, high or low water levels; (c) nuclear or other industrial accident causing environmental pollution or contamination; (d) epidemics, pandemics, quarantines or any other public health crisis, including COVID-19 and its variants; (e) the administration or liquidation or similar failure of any operator of a component of the package; or (f) change in law, meaning enactment, amendment (including repeal) in the law or administration of any law in Australia or any jurisdiction or territory relevant to the booking contract, which includes changes in statute, regulation determination, by-law, declaration, licence and the common law as applicable from time to time, including but not limited to travel or movement restrictions imposed by state, federal or foreign governments.

Cancellation or Change to Travel Arrangements due to Force Majeure

If Cruises by Inspiring Vacations, in its reasonable opinion, considers that any Force Majeure event prevents Cruises by Inspiring Vacations (whether directly or indirectly through its employees, contractors, subcontractors and agents) from lawfully or safely providing any products or services subject to the booking contract with you, Cruises by Inspiring Vacations may immediately by written notice: (a) terminate your booking contract (in whole or in part); or (b) change your travel arrangements as reasonably practicable to ensure your safety and invoice you for any additional costs.

Limitation of Liability in the Event of Force Majeure

In the event of a force majeure event making it impossible or unsafe for Cruises by Inspiring Vacations to deliver all or part of the package, Cruises by Inspiring Vacations will not be obliged to provide a refund for unperformed parts of the package. Instead, a credit will be issued to the value of amounts paid towards unperformed parts of the package less the value of unrecoverable costs incurred prior to the force majeure termination of the travel arrangements. Such costs may amount to a substantial proportion of the booking price and may include, but is not limited by, airline or cruise cancellation fees, charter commitments and a proportion of operating costs incurred in the normal running of the business, which may include, but will not be limited to, those incurred in the procurement, acquisition, management and fulfilment of a typical booking. Such fees are incurred in the normal operation of the business, including to provide high levels of quality, service and safety before and during a customer's travel experience. Cruises by Inspiring Vacations will use its reasonable endeavours to minimise losses incurred by customers, however, the extent of such costs can only be known at the time of cancellation and may be dependant on such factors as a package's components, the booking's stage in fulfilment or specific requests made in relation to the booking. In order to maximise the value provided to customers in the case of a Force Majeure event, credits may be issued against any third party supplier responsible for delivering a component of your package. We encourage customers to take out travel insurance to protect themselves against loss in such circumstances.

By agreeing to these terms, you acknowledge that Cruises by Inspiring Vacations being prohibited from delivering your package by reason of Force Majeure has been considered as a potential, though unlikely, outcome. In response to such a Force Majeure event, you acknowledge that the contract has not been frustrated for the reason that the contract can continue to be fulfilled through the issue of a credit towards future travel. You acknowledge that Cruises by Inspiring Vacations reserves the right to cancel any issued credit in the event of recovery proceedings of any form being initiated and to recover any costs incurred in the event of a breach of this contract by you.

Issued credit may be used on the Cruises by Inspiring Vacations website only unless expressly approved otherwise and availability and validity restrictions may apply.

Limitation of Liability

Our packages may comprise the services of multiple independent providers who are not agents or employees of Cruises by Inspiring Vacations and whose day to day operations are beyond the control of Cruises by Inspiring Vacations. While all care is taken in selecting those providers, Cruises by Inspiring Vacations is not responsible for the provision of that service or for any resulting injury, illness or loss of enjoyment. By purchasing your package, you acknowledge and assume the inherent risks associated with your chosen destination or package activities. It is the customer’s responsibility to familiarise themselves with the terms and conditions applicable to each service provider.

Cruises by Inspiring Vacations accepts no responsibility for any death, injury, illness, loss (including loss of enjoyment), damage, detention, delay (including mechanical breakdown) beyond its control.

Any term, condition or warranty expressly or implied by statute or otherwise in respect of the holiday packages contained in the brochure are excluded to the full extent permitted by law. Nothing in these booking conditions excludes, restricts or modifies the application of the Competition and Consumer Act 2010 (Cth) as amended, consolidated, supplemented or replaced.

To the full extent permitted by law, Cruises by Inspiring Vacations’ liability arising under or in connection with these booking conditions: (a) is limited to the resupply of the package purchased or the equivalent cost of supplying that package; and (b) excludes liability for any indirect or consequential losses suffered by you or any third party however caused, including but not limited to pure economic loss or any special, extraordinary or punitive damage to you or any other party.

Indemnity

You agree to indemnify Cruises by Inspiring Vacations and its directors, officers and employees against any loss, including legal fees, or liability arising from your own conduct or breach of this agreement.

These terms are governed by the laws of Victoria, Australia.
